As such, Shellsoft offers a wide range of products in the areas of core infrastructure, virtualization, enterprise and mobile security, data management, workflow, systems and endpoint management and productivity.

    Based on the Company’s established Data Privacy Policy, ensures the Company’s, its employee’s, and its business partners’ compliance with Republic Act No. 10173 or Data Privacy Act of 2012 (DPA); and other existing laws and regulations relating to the handling of Personal Information.

This Data Privacy Notice describes the way in which the Company collects, process, records, use, and store personal information or data about you; how it safeguard your personal information or data; and interact with affiliates and third parties that may have access to your personal data and finally; how you can contact us in case of questions or clarifications.

    By using this website or sending your inquiry through the website, you consent to the collection and use of your personal data. The personal data obtained from you is entered and stored within the Company’s authorized information and communications system and will only be accessed by the appropriate authorized personnel. The Company have instituted appropriate organizational, technical and physical security measures to ensure the protection of the customers’ personal data.

    This Notice shall not operate to supersede nor affect any consent or right previously given.

However, the Company may need to provide your information to affiliates and subsidiaries in relation to delivering specific services to you.

      7. To the extent as permitted or required by applicable laws, including compliance with applicable rules, laws, regulations, codes of practice or guidelines issued by any legal or regulatory bodies that are binding on Shellsoft; and

      When the use of the Personal Information is for any other purposes other than enumerated above, we will ask for your consent. In case you will provide information or data of a third party, you are assumed to have secured from such third party the required consent for the use and disclosure of the information or data.

      In case of disclosure, reasonable steps shall be taken to ensure compliance with applicable privacy laws and regulation; protection against authorized disclosures; and to ensure that the information is disclosed on a confidential basis.

      Personal Information, in a form which permits identification of Data Subjects, shall be retained only for as long as necessary for the fulfillment of the purposes for which the data was obtained, collected, and processed; or for the establishment, exercise or defense of legal claims; or for legitimate business purposes; or as provided by law.

      Thus, personal data collected and processed by Shellsoft will be stored only for as long as required to fulfill the purposes for which the information or data was obtained, collected, or processed, as outlined in this Policy, and for a period of at least one (1) year upon the fulfillment of such purposes, unless a different period is agreed upon the concerned party or is required by law.

      Personal information collected for other purposes may lie processed for historical, statistical or scientific purposes, and in cases laid down in law may be stored for longer periods; provided that adequate safeguards are guaranteed by said laws authorizing their processing.

    5. The following are your rights in relation to your personal information or data under the Republic Act No. 10173 or Data Privacy Act of 2012 (DPA) :

    1. Right to be informed – you to be notified of the processing of personal information, including its description and amendment thereof; purposes, scope, and method of processing; period of retention thereof

    2. Right to access – you have the right to access personal information in the portal or interface where available; and other information or data relating to its collection, source, processing, and disclosure.

    3. Right to rectify or correct erroneous data – you have the right to correct your personal information or data if it is found to be outdated or inaccurate, unless request is vexatious or otherwise unreasonable.

    4. Right to erase or block – you have the right to request blocking, removal, destruction, or erasure of your personal information or data such as it is no longer necessary to achieve legitimate business purpose.

    5. Right to secure data portability – you have the right to secure a copy of a personal information or data processed by electronic means in a commonly used electronic or structure format that will allow the Data Subject’s further use thereof.

    6. Right to withdraw consent – you have the right to withdraw your authorization and consent for the additional personal information or data collected. But any withdrawal of consent will not affect the processing of information based on previous consent given prior to the withdrawal.

    7. Right to be indemnified – you have the right to be indemnified for any damages sustained due to such inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal information.

    6. Shellsoft shall assign a Data Privacy Officer that shall ensure implementation of personal information processing principles set out in this Policy.
